News Release

Are your green technology patents being prosecuted under the USPTO's Green Technology Patent Program?

  • The United State Patent and Trademark Office's (USPTO) Green Technology Patent Program has been extended and is open to the first 3,000 applications filed on or before December 31, 2011.
  • To qualify for the extended program, an application must either:

    materially enhance the quality of the environment;

    or materially contribute to:

    • (1) the development of a renewable energy source or energy conservation; or
    • (2) the reduction of greenhouse gas emissions.
  • Applicants whose previous requests to participate were denied, can re-file under the expanded criteria.
  • Qualifying applications will be advanced out of turn for examination by the USPTO if they have no multiple dependent claims and have three or fewer independent claims and twenty or fewer total claims; and if the applicant is willing to restrict the application to a single invention, if required.
  • To date, 800 petitions have been granted and 106 patents have been issued under the program. The program began on December 8, 2009.
  • Expected benefit of participation in program - The average patent under this program has been issued one year earlier than expected.
